IMPLEMENTASI PERDA KOTA PONTIANAK NO. 01 TAHUN 2010 TENTANG KETERTIBAN UMUM DI KOTA PONTIANAK

Abstract

Penelitian ini didasari pada permasalahan mengenai belum optimalnya pelaksanaan aturan terkait dengan larangan mengemis di tempat umum di Kota Pontianak hal ini ditandai dengan masih ada pengemis yang berkeliaran di Kota Pontianak, belum optimalnya penyaluran komunikasi yang dilakukan pemerintah kepada pengemis, belum tercukupinya sumber daya yang tersedia dalam mendukung terlaksananya Perda terkait larangan mengemis di tempat umum. Tujuan penelitian ini dimaksudkan untuk mengetahui dan menganalisis faktor-faktor yang mempengaruhi Implementasi Perda Kota Pontianak No.01 Tahun 2010 tentang Ketertiban Umum mengenai larangan mengemis di tampat umum di Kota Pontianak. Dalam penelitian ini menggunakan teori George C. Edwards III dimana terdapat empat (4) faktor yang mempengaruhi, yaitu komunikasi, sumber daya, disposisi, dan struktur birokrasi. Penelitian ini adalah penelitian deskriptif dengan pendekatan kualitatif. Hasil penelitian ini apabila dilihat dari aspek komuikasi masih belum baik, ini dilihat dari belum optimalmya pemahaman yang jelas, seimbang dan, lancar antara implementor dan para pengemis, pada aspek sumber daya dilihat dari kurangnya anggota dari implementor serta fasilitas yang kurang memadai, Disposisi atau sikap pelaksana yang juga kurang berkomitmen dan kurang tugas dalam menegakkan aturan yang berlaku. Struktur birokrasi yang baik namun fregmentasi (penyebaran tanggungjawab) yang belum maksimal pada instansi terkait.

ABSTRACT

This research is based on the problem of the lack of optimal implementation of rules relating to the prohibition of begging in public places in Pontianak City. It is indicated that there are still beggars roaming the city of Pontianak, the communication channeling of the government to beggars is not optimal, there are not enough resources available to support the implementation of local regulations related to the prohibition of begging in public places. The purpose of this study is to find out and analyze the factors the influence the Implementation of Pontianak City Regulation No. 01 of 2010 concerning Public Order concerning the prohibitiom of begging in public places in Pontianak City. In this study using the theory of George C. Edwarads III where the four (4) factors that influence, namely communication, resources, disposition, and bureaucratic structure. This research is a descriptive study with a qualitative approach. Through the results of this study, if it is still seen from the aspect of communication still not good, this is seen from the not yet optimal, balanced, and smooth understanding between the implementor and the beggars, of the aspect of resources can be seen from the lack implementor members and inadequate facilities, dispositions or the attitude of the executor who is also less committed, and less responsible for the task of enforcing the applicable rules. A good bureaucratic structure but fragmentation (dissemination of responsibilities) that has not been maximized in the relevant agencies.
